Terms of Service
In short. Geonary is a tool for looking at your own movement history. Your data is yours and it stays on your device — which also means keeping it safe is on you, because we hold no copy to restore. The map is a picture of where you have been, not a navigation instrument.
1. The agreement
These terms are an agreement between you and Zamrudila, the operator of Geonary, covering the Geonary mobile app. By installing or using it you accept them.
If you got Geonary from the Apple App Store or Google Play, that store's terms also apply to the download and the transaction, and take precedence over these terms for that transaction.
2. Your licence
You get a personal, non-transferable licence to use Geonary on devices you own, for your own non-commercial use. You may not resell, sublicense, rent, reverse engineer or decompile the app, except where applicable law says you may regardless of this restriction. Geonary, its name and its design remain ours.
3. Geonary Lifetime
- Geonary is usable without paying. Lifetime is a one-time purchase that permanently unlocks the additional time ranges and views described on the purchase screen. It is not a subscription and does not renew or expire.
- "Lifetime" means the lifetime of the app. It is not a promise that Geonary will be published or supported forever, and it does not oblige us to ship any particular future feature.
- The purchase belongs to the App Store or Google Play account that made it. Use Restore purchase in Settings on a new device or after a reinstall.
- Payments and refunds are handled by Apple or Google under their policies, not by us. Your statutory consumer rights are unaffected.
- We may change the price of future purchases. That never affects an unlock you already own.
4. Your data
Your recorded history is yours and is stored on your device. See the Privacy Policy for what that means in detail.
There is no backup. If you lose, reset or replace your device, or uninstall the app, your recorded history is gone and we cannot recover it. Deleting from within the app is immediate and irreversible.
You are responsible for complying with the laws that apply to you when recording location.
5. What the map is, and is not
Geonary shows an approximation. Positions come from your device's location services and carry the usual error; recorded points may be matched to nearby roads to make the map readable, so a drawn route can differ from the path you actually took. Gaps occur whenever location services are unavailable, denied or restricted.
Do not rely on Geonary for navigation, for emergency or safety-critical purposes, or as a record of fact — for legal proceedings, insurance, employment monitoring, mileage or expense claims, or tax. It is not built or verified for any of those.
6. Acceptable use
You agree not to use Geonary:
- to track or monitor another person without their informed consent, or in any way that is unlawful where you are;
- to disrupt or place unreasonable load on any service the app relies on, including the map tile provider;
- to circumvent the purchase mechanism or any technical restriction.
7. Map data and third-party services
Map tiles are supplied by Esri / ArcGIS using data that includes OpenStreetMap contributions, available under the Open Database Licence. Their terms and attribution requirements apply to that content, which is provided by them and not by us. We are not responsible for third-party services or their availability.
8. Availability and changes
We may change, suspend or discontinue Geonary or any of its features at any time. If we update these terms we will change the date at the top of this page, and a material change will be announced in the app before it takes effect.
9. No warranties
Geonary is provided "as is" and "as available", without warranty of any kind. We do not warrant that it will be uninterrupted or error-free, or that recorded data will be complete, accurate or preserved. Where your jurisdiction does not allow these exclusions, they apply only as far as permitted and your mandatory consumer rights are unaffected.
10. Limitation of liability
To the fullest extent permitted by law we are not liable for indirect, incidental, special or consequential damages, nor for loss of data, profits or goodwill — including loss of recorded history for any reason. Our total liability is limited to what you actually paid for the app in the twelve months before the claim, or to zero where you paid nothing.
Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.
11. Termination
You can end this agreement at any time by uninstalling Geonary. We may end your licence if you materially breach these terms. The sections on data, warranties, liability and governing law survive.
12. Governing law
These terms are governed by the laws of the Republic of Türkiye, and the courts of İzmir have jurisdiction. If you are a consumer this does not deprive you of the protection of the mandatory consumer law where you live, nor of the right to bring proceedings there.
